Key Patrol™ Terms and Conditions

AirKey™ / Air Tracker™ Products and Key Patrol™ Services

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. These Terms and Conditions (“Terms”) govern the purchase, registration, activation, access to, and use of Key Patrol™ AirKey™, Air Tracker™, related tracking devices, mobile applications, websites, portals, software, connectivity, and related services (collectively, the “Key Patrol Services”). By purchasing, accepting, registering, activating, signing for, or using a Key Patrol product or Service, you acknowledge that you have read, understood, and agree to these Terms.

1. Product Purchase and End-User Registration

A Key Patrol™ AirKey™ fob, Air Tracker™, or other applicable Key Patrol device may be purchased or provided in connection with a vehicle, dealership program, business program, or other authorized transaction. Where applicable, the device may be associated with the registered vehicle, VIN, customer account, key set, equipment, or other authorized property.

Following the sale or transfer of the product to the end user, Key Patrol or an authorized dealer, agent, distributor, or program partner may submit the end user’s information for registration. A unique registration or welcome email may then be sent to the valid email address provided for the end user. The registration communication may contain credentials, links, instructions, device information, or other information required to access the Key Patrol Services.

2. Acceptance of Terms

The customer’s signature, electronic approval, acceptance at the time of purchase, completion of registration, activation of a device, creation or use of a Key Patrol account, or continued use of the Key Patrol Services constitutes acceptance of these Terms, to the extent permitted by applicable law.

The current Terms may be made available through the Key Patrol application, account settings, registration materials, or at KeyPatrolAir.com/terms. If you do not agree to these Terms, do not activate or use the Key Patrol Services.

3. Registration and 120-Day Requirement

The end user is responsible for providing a valid email address and completing the applicable login, registration, pairing, and account setup process. Users should check their inbox, spam, and junk folders for the Key Patrol registration or welcome email.

Where the applicable program requires registration within 120 days after the product or registration information is issued, failure to complete the required registration within that period may result in limitation, suspension, expiration, or termination of app, connectivity, tracking, or other service access, subject to the applicable program documents and applicable law. This service-registration requirement does not eliminate any nonwaivable product-warranty rights provided by law.

4. Key Patrol™ Pro Application and Account Access

Where applicable, the end user must download the designated Key Patrol™ Pro or other Key Patrol mobile application and use the credentials or registration process provided by Key Patrol. The user is responsible for maintaining the confidentiality of account credentials and for activity occurring through the user’s account.

Mobile device compatibility, Bluetooth permissions, location permissions, internet access, cellular service, operating-system settings, and other third-party requirements may be necessary for certain features to operate.

5. Authorized Use and Prohibited Tracking

Key Patrol products and services are intended for the authorized location and management of vehicles, keys, equipment, assets, and other property. They are not intended to be used unlawfully or without authorization to track, monitor, follow, surveil, harass, intimidate, or stalk any person.

You must not place, install, activate, or use a Key Patrol device on any person, vehicle, asset, or other property unless you own the property, have lawful authority to track it, or have obtained any consent required by applicable law. Key Patrol may suspend or terminate access associated with unlawful, abusive, deceptive, fraudulent, or unauthorized use.

6. Location and Technology Limitations

Key Patrol products may use Bluetooth Low Energy (BLE), GPS, cellular networks, Wi-Fi, crowd-location networks, gateways, smartphones, cloud services, maps, APIs, or other technologies. Location and status information may be delayed, approximate, incomplete, duplicated, inaccurate, or unavailable.

Key Patrol does not guarantee continuous detection, uninterrupted connectivity, exact or real-time location, successful recovery of lost or stolen property, or availability of any third-party network or service. A displayed location or “last seen” location is informational and is not proof of the current location, custody, theft, or recovery of an item or vehicle.

7. Product Warranty

Eligible Key Patrol hardware is subject to the applicable Key Patrol™ Limited Product Warranty or Limited Manufacturer’s Warranty provided with or applicable to the product. The warranty document, rather than these Terms, controls the specific duration, covered hardware defects, exclusions, claim procedures, and remedies applicable to a warranty claim.

Unless expressly stated in the applicable warranty or required by law, ordinary battery depletion, normal wear, misuse, unauthorized modification, loss or theft of the product, third-party network failures, and inability to locate or recover attached property are not hardware defects.

8. Purchase, Cancellation, and Refund Terms

Certain Key Patrol products are sold or provided as part of a completed vehicle, dealer, business, or program transaction. Where the applicable signed purchase agreement or program document states that the Key Patrol purchase is non-cancelable, the purchase is non-cancelable after completion except where cancellation, refund, or other rights are required by applicable law or expressly provided in the governing transaction documents.

Nothing in these Terms limits any cancellation, refund, warranty, or other consumer right that cannot legally be waived.

9. Third-Party Services

Some Key Patrol features depend on third-party mobile devices, operating systems, app stores, wireless carriers, GPS systems, Bluetooth environments, mapping providers, cloud providers, internet access, or other third-party services. Key Patrol does not control and cannot guarantee the availability, accuracy, compatibility, latency, security, or continuation of those third-party services.

10. Safety and Recovery

Do not use Key Patrol location information in a manner that creates an unsafe situation. If you believe a vehicle or other property has been stolen, contact the appropriate law-enforcement authority. Do not confront a suspected thief or enter private property solely based on a location displayed by a Key Patrol product or Service.

11. Privacy

Use of Key Patrol Services is subject to the applicable Key Patrol™ Privacy Policy. Location, device, account, registration, technical, and usage information may be processed as described in that policy and as permitted by applicable law.

12. Disclaimer and Limitation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KEY PATROL SERVICES AND LOCATION-RELATED INFORMATION ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS EXCEPT FOR EXPRESS WARRANTIES PROVIDED IN THE APPLICABLE WRITTEN PRODUCT WARRANTY.

KEY PATROL DOES NOT WARRANT THAT A PRODUCT OR SERVICE WILL PREVENT LOSS, THEFT, MISPLACEMENT, DAMAGE, OR LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEY PATROL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OR INABILITY TO USE LOCATION OR TRACKING SERVICES. These limitations do not apply to liability or rights that cannot legally be excluded or limited.

13. Suspension or Termination

Key Patrol may suspend, restrict, or terminate access to Services for material violation of these Terms, unlawful or unauthorized tracking, fraud, abuse, security threats, nonpayment of an applicable service fee, expiration of an applicable service term, or other grounds permitted by the applicable program documents and law.

14. Changes to These Terms

Key Patrol may update these Terms from time to time. Updated Terms will be posted or otherwise made available through the applicable website, application, account, or other reasonable notice method. Changes will apply prospectively as required by applicable law.
